Amendment the Oak Park Building Code
Regarding Housing


One of the goals of the Task Force on Policy for Promoting Access which was stated in its report accepted by the Village Board on July 1, 1996 was “The Village should pass an ordinance that will lead to creation of more accessible private housing in existing and new buildings in Oak Park.”

At the March 28 Commission meeting, chief building inspector David Myers stated that the Village is planning to adopt the International Building Code 2000 in the near future. He said that many elements of the Federal Fair Housing Amendments Act are currently incorporated in the IBC 2000. Based on our discussion at that meeting, the following revisions are proposed to be made to IBC 2000 to bring them into line with our draft housing proposal.


Revise paragraph 1107.5.4 on page 219 as follows:

1107.5.4 Accessible dwelling units. In occupancies in groups R-2 and R-3 as applicable in Section 101.2 where there are four two or more dwelling units in a single structure, every dwelling unit shall be a Type B dwelling unit. …

[this revision will require accessibility for first floor units in all apartment buildings, condominiums, and townhouses where there are two or more units in the same structure, instead of the IBC threshold of four or more units]

Revise the Exemptions paragraph 3 after paragraph 1107.5.4 on page 219 as follows: Exemptions:

3. Where multistory dwelling unit is provided with elevator service to only one floor, the floor provided with elevator service shall comply with the requirements for a Type B dwelling unit, and a toilet facility shall be provided on that floor. Multistory dwelling units located on the first floor of a structure shall have spaces on their first floor level comply with requirements for a Type B dwelling unit, and shall provide a toilet facility on that floor.

[This revision will require all two-story townhouses which are located on the first floor of a building and two-story townhouses which are served by elevators to make their first floor level accessible]


Add the following new paragraph to Section 3408.3, on page 586:

3408.3.1 Conversion of an Existing Building to a Condominium. Unless technically infeasible, provisions for new construction of occupancies in groups R-2 and R-3 for accessibility shall apply to conversion of existing buildings to condominium use where there will be two or more dwelling units in a single structure.

[This revision will apply new construction standards to condominium conversions, unless it is technically infeasible to do so – Technical Infeasibility is defined in the IBC in paragraph 1102]
